Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Entrepreneur: the natural or legal person who offers products to consumers via the webshop.
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.
Distance contract: an agreement concluded exclusively through means of distance communication (such as a webshop and email).
Article 2 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer in the Netherlands and Belgium.
Before the contract is concluded, the text of these general terms and conditions will be made available via the webshop.
Article 3 – The Offer
The offer contains a complete and accurate description of the products offered.
Obvious mistakes or errors in the offer are not binding on the entrepreneur.
All prices include VAT (21% in Belgium and the Netherlands) and exclude shipping costs, unless stated otherwise.
Article 4 – The Contract
The contract is concluded at the moment the consumer accepts the offer and complies with the conditions set.
If the consumer has accepted the offer electronically, the entrepreneur will promptly confirm receipt of the acceptance.
Article 5 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period starts on the day after the consumer, or a third party designated by the consumer, has received the product.
During the withdrawal period, the consumer shall handle the product and packaging with care.
If the consumer exercises the right of withdrawal, the costs of return shipping are at their expense.
The entrepreneur will refund the amount paid as soon as possible, but no later than 14 days after withdrawal.
Article 6 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for products that:
are made according to the consumer’s specifications;
can spoil quickly or have a limited shelf life;
are not suitable for return for hygienic reasons if the seal has been broken.
Article 7 – Delivery
The entrepreneur will execute orders with due care.
The place of delivery is the address provided by the consumer when placing the order.
The entrepreneur will execute accepted orders within 30 days at the latest, unless a different delivery period has been agreed.
Article 8 – Payment
Unless otherwise agreed, the consumer must pay the amount due immediately when placing the order.
In the event of non-payment by the consumer, the entrepreneur has the right to charge statutory interest and collection costs.
Article 9 – Warranty
Consumers in the Netherlands and Belgium are entitled to a statutory warranty of 2 years on products, unless stated otherwise.
The warranty does not apply in the case of damage caused by improper use, normal wear and tear, or negligence.
Article 10 – Complaints Procedure
The entrepreneur has a sufficiently publicized complaints procedure.
Complaints about the performance of the contract must be submitted within a reasonable time after the defect has been discovered, fully and clearly described.
Complaints submitted to the entrepreneur will be answered within 14 days.
Article 11 – Applicable Law
Contracts between the entrepreneur and the consumer to which these terms and conditions apply are governed exclusively by Dutch or Belgian law, depending on the consumer’s country of residence.
